2. Acceptance of the Terms

By accessing https://amazingecuadorphotography.com/ (the “Site”), registering, or making a purchase, the User declares that they have read, understood, and expressly accepted these Terms and Conditions. Access is restricted to individuals under 18 years of age. If you do not agree, you must not use this Site or purchase products.

3. Purpose of the Site

The Site is intended for the commercialization of:

  • Downloadable digital photography files.
  • Physical prints of such photographs, with national and international shipping.

4. Access and Use of the Site

The User agrees to use the Site lawfully and in accordance with applicable legislation. The following are prohibited:

  • Using the Site for fraudulent or unlawful purposes.
  • Introducing viruses or systems that damage the portal.
  • Accessing with third-party credentials or sharing one’s own.

5. User Registration and Data

To make purchases, the User must provide accurate, current, and truthful data. The User is responsible for safeguarding their credentials and for all operations carried out with them.

6. Purchase Process and Electronic Contracting

  • Once payment is confirmed, the sales contract is perfected.
  • The User will receive confirmation at their registered email along with an electronic invoice in accordance with Ecuadorian regulations.
  • Electronic contracts are fully valid under Ecuadorian law, according to the Electronic Commerce Law.

7. Payment Methods, Prices, and Invoicing

  • Prices are expressed in United States dollars (USD) and include taxes unless otherwise indicated.
  • Payments are accepted via PayPal, credit/debit cards, and other methods available on the Site.
  • Banks or payment gateways may charge additional fees not attributable to Amazing Ecuador Photography.
  • For international purchases, the User assumes the taxes and duties of their destination country.

8. Product Delivery

8.1 Digital Files

  • Available for immediate download or within the timeframe indicated on the Site.
  • Once downloaded, no returns are accepted unless the file is defective.

8.2 Physical Prints

  • Delivery times will depend on the User’s location.
  • International shipments may be subject to customs, taxes, or delays.
  • The risk of loss or damage transfers to the User once the product is handed over to the carrier.
  • In case of defects, damage, or delivery errors, the User must notify within 7 days of receipt.

9. Return and Refund Policy

  • Digital files: No returns or refunds are accepted once downloaded, except for corrupted files or product errors.
  • Physical prints: Exchanges or replacements are accepted in case of damage, defect, or shipping error, subject to verification.
  • Returns are not accepted for reasons of personal preference.

10. License of Use and Intellectual Property

  • All photographs are the exclusive property of Amazing Ecuador Photography and/or their authors.
  • The User acquires a limited, non-exclusive, non-transferable license for personal or commercial use according to the type of license purchased.
  • The following are prohibited:
  •     - Reselling, sublicensing, or redistributing the digital file in its original format.
  •     - Using photos in illegal, defamatory, or unauthorized projects.
  • Large-scale commercial use (e.g., merchandising, unlimited reproductions) without an extended license.
  • Violation will result in legal action for copyright infringement.

11. Limitation of Liability

  • Amazing Ecuador Photography does not guarantee uninterrupted availability of the Site.
  • The maximum liability towards the User will not exceed the amount paid in the transaction.
  • No responsibility is assumed for delays, customs, third-party errors, or improper use of photos.

12. Privacy and Data Protection

  • Personal data is collected solely to process purchases, billing, and customer service.
  • Technical and administrative security measures are applied to protect the information.
  • Data processing complies with Ecuador’s Organic Law on Personal Data Protection (LOPDP).
  • The User gives express consent by registering their data.

13. Modifications to the Terms

Amazing Ecuador Photography may modify these Terms at any time, notifying through the Site. Purchases made will be governed by the Terms in effect at the time of the transaction.

14. Applicable Law and Jurisdiction

  • These Terms are governed by the laws of the Republic of Ecuador.
  • In case of dispute, the parties may resort to arbitration at the Arbitration and Mediation Center of the Quito Chamber of Commerce, in accordance with the Arbitration and Mediation Law.
